Why GDPR-compliant GPU hosting starts with jurisdiction

GDPR-compliant GPU hosting is mostly decided before the first byte is processed: by who owns the hardware and which laws reach it. A GPU in an EU region of a US-owned cloud sits on European soil but inside a foreign legal perimeter — the US CLOUD Act can compel the parent company regardless of where the disks spin, and FISA 702 is the reason EU–US transfer frameworks keep ending up in court. If your DPO has to document that scenario away, the paperwork never really closes.

Dedicated instances make Article 32 simpler

GDPR's security-of-processing article asks for measures "appropriate to the risk". Tenant isolation is the first one auditors probe, and dedicated hardware answers it cleanly: your workload is not a container squeezed next to a stranger's on a marketplace host. With full root access you also control the stack yourself — encrypt volumes at rest with your own keys, restrict inbound access, and wipe or keep data on your schedule. Paused instances resume with processes and GPU memory intact, and paused time is never billed, so compliance-friendly caution costs nothing extra.

Paperwork: DPA, roles, sub-processors

For most workloads you act as controller and EponEdge as processor. An Article 28 data processing agreement for the GPU cloud is available — ask sales and we will provide the DPA and current processing documentation, including the sub-processor situation, for your compliance file. What you still own as controller

Honest scope: infrastructure cannot make your project lawful on its own. You still choose the lawful basis, minimise what you upload, run a DPIA where your use case requires one, set retention, and answer data-subject requests. Is running AI on a GPU cloud a data transfer under GDPR?

It is processing, and it becomes a restricted international transfer if the data leaves the EEA or falls under a non-EEA jurisdiction. On EponEdge, processing happens on European-owned hardware in Belgium under EU jurisdiction, so no transfer mechanism — SCCs, adequacy decisions or supplementary measures — is needed for the hosting itself.
